Intertidal® is a **registered trademark (National Trademark No. 604326)** at the Portuguese Institute of Industrial Property (INPI).
Intertidal® is licensed to operate as a **Tourism Entertainment Operator** and is registered in the **National Register of Tourism Entertainment Agents (RNAAT) No. 349/2019**, regulated by Turismo de Portugal.
Intertidal® is also recognised by **ICNF (Institute for Nature Conservation and Forests)** for the practice of Nature Tourism activities.

3. Scope of Services
Intertidal® provides guided outdoor activities and tourism entertainment services, including nature-based experiences such as boat tours, kayaking, stand-up paddleboarding, canoeing, and guided nature activities.
Service descriptions provided on the website or in client proposals are as accurate as possible. However, the exact format and content of activities may be subject to minor adjustments depending on:
* weather conditions
* seasonal factors
* safety considerations
* operational requirements
Any significant changes will be communicated to the client prior to the activity whenever possible.

All content available on this website, including but not limited to:

is the exclusive property of Intertidal® unless otherwise stated and is protected under Portuguese and international copyright laws.

5. Environmental Code of Conduct
Intertidal® and all participants in its activities are committed to respecting the natural and cultural heritage of the regions where activities take place.
Participants must respect:
* the ICNF code of conduct for nature tourism
* private property
* wildlife habitats and ecosystems
* cultural and environmental values of the region
Participants must also comply with all applicable regulations issued by relevant authorities, including but not limited to:
* Capitania do Porto de Peniche
* Município de Caldas da Rainha
* Município de Óbidos
* Agência Portuguesa do Ambiente (APA)
* Instituto da Conservação da Natureza e das Florestas (ICNF)
* Coastal management regulations (POOC)

6. Bookings and Payments
Participation in Intertidal® activities requires a prior reservation made through:

* email reservation at [reservas@intertidal.pt](mailto:reservas@intertidal.pt).
By submitting a reservation request, the client confirms the intention to purchase the selected service and accepts these Terms and Conditions.
Payment Conditions
Payment conditions may vary depending on the type of activity.
For **single-day scheduled activities**, payment may be made at the meeting point prior to the start of the activity.
For **activities involving third-party partners or special arrangements**, advance payment may be required. Payment instructions will be provided in the reservation confirmation email.
Accepted payment methods may include bank transfer or other methods specified by Intertidal®.
Invoices may be issued upon request if the client provides their Portuguese tax number (NIF) at the time of payment.

7. Client Responsibilities
By booking an activity, the client confirms that:
* they have read and accepted these Terms and Conditions
* they are physically and medically fit to participate in the selected activity
* they understand the nature of outdoor adventure activities and the inherent risks involved
* they will follow all safety instructions provided by guides or instructors
Participants must inform Intertidal® in advance if they suffer from any medical condition that may affect their ability to participate safely.
Where necessary, a medical certificate may be requested.

8. Safety Rules
Intertidal® activities follow strict safety standards in accordance with applicable Portuguese regulations.
However, due to the nature of outdoor adventure activities, inherent risks cannot be completely eliminated.
Participants must:
* comply with all safety instructions provided by guides or instructors
* use all mandatory safety equipment provided
* behave responsibly towards other participants and the environment
For water-based activities such as:
* boat tours
* kayaking
* canoeing
* stand-up paddleboarding
the use of **personal flotation devices (life jackets)** is mandatory.
Failure to comply with safety instructions may result in **immediate exclusion from the activity without refund**.

9. Schedules and Meeting Times
Activity durations indicated on the website or in proposals are **approximate** and may vary due to weather conditions or other operational factors.
Participants are expected to arrive at the designated meeting point at the scheduled time.
A tolerance period of **15 minutes** may be granted before the activity begins.

10. Transport
Unless explicitly stated otherwise, transportation or transfers to activity locations are **not included** in the services provided by Intertidal®.
Route descriptions included in activity programs are indicative and may be adjusted where necessary.

11. Cancellations and Refunds
Cancellation by Intertidal®
Intertidal® reserves the right to cancel or modify activities if:
* minimum participant numbers are not reached
* weather conditions make the activity unsafe
* operational or safety conditions are not met
In such cases, clients will be offered:
* an alternative date, or
* a refund when applicable and feasible.

Cancellation by the Client
Activities up to 1 day
Clients may receive a **full refund** if cancellation occurs **at least 72 hours before the activity**, provided Intertidal® has not already incurred non-recoverable costs with third-party suppliers.
Activities longer than 1 day
Cancellation must be made **at least 30 days before the activity start date**. After this period, cancellation may result in:
* partial charges for incurred costs
* loss of the total amount paid
* issuance of a voucher for future activities where possible.

12. Insurance and Liability
Intertidal® maintains the mandatory insurance required under Portuguese law for tourism entertainment operators, including:
* Personal Accident Insurance
* Civil Liability Insurance
* Assistance Insurance for Participants
Insurance coverage applies **only during the scheduled activity period**.
Insurance may not apply where accidents occur as a result of:
* activities performed outside the official program
* failure to follow guide instructions
* deliberate violation of safety rules
Any accident must be reported within **72 hours after the activity**.

13. Use of Images
Photographs or videos captured during Intertidal® activities may be used for promotional purposes on:
* the Intertidal® website
* social media platforms (such as Facebook, Instagram, YouTube)
Participants who do not wish their image to be used must notify Intertidal® in writing via email at [info@intertidal.pt](mailto:info@intertidal.pt).

14. Website Availability and Security
Intertidal® does not guarantee uninterrupted availability of the website and may modify or suspend it at any time without prior notice.
Intertidal® shall not be liable for damages resulting from:
* temporary website unavailability
* viruses or malicious software
* errors in website content.

15. Amendments
Intertidal® reserves the right to modify these Terms and Conditions at any time. Updated versions will be published on the website with the revised date.

16. Governing Law and Jurisdiction
These Terms and Conditions are governed by **Portuguese law**.
Any dispute arising from the use of this website or Intertidal® services shall fall under the exclusive jurisdiction of the **courts of Caldas da Rainha, Portugal**, with express waiver of any other jurisdiction.
17. Force Majeure
Intertidal® shall not be held liable for failure to perform or delay in performing its obligations when such failure or delay results from events beyond its reasonable control.
Such events may include, but are not limited to:
* extreme weather conditions
* natural disasters
* maritime authority restrictions
* accidents or emergencies
* government restrictions or public health measures
* strikes or labour disputes
* transport disruptions
In such circumstances, Intertidal® will make reasonable efforts to:
* reschedule the activity to an alternative date, or
* provide a voucher or refund where appropriate.

18. Assumption of Risk
Participation in outdoor and adventure tourism activities involves inherent risks that cannot be completely eliminated despite all reasonable safety measures.
By participating in Intertidal® activities, clients acknowledge and accept that:
* outdoor environments are unpredictable
* physical effort may be required
* weather, terrain, and water conditions may change rapidly
* minor injuries or accidents may occur despite proper supervision
Participants agree to assume responsibility for their participation and to follow all safety instructions provided by Intertidal® guides or instructors.
Failure to follow safety instructions may result in exclusion from the activity without refund.

19. Data Protection (GDPR)
Intertidal® processes personal data in accordance with the **General Data Protection Regulation (EU) 2016/679 (GDPR)** and applicable Portuguese data protection legislation.
Personal data collected through the website or booking process may include:

* managing reservations

20. Limitation of Liability and Participant Responsibility
Intertidal® organizes outdoor and nature-based activities in accordance with applicable Portuguese regulations governing tourism entertainment operators and maintains all legally required safety procedures and insurance coverage.
While every reasonable precaution is taken to ensure participant safety, clients acknowledge that outdoor activities inherently involve certain risks, including but not limited to:
* changing weather conditions
* water and maritime environments
* uneven terrain or natural obstacles
* physical exertion
* unforeseen environmental factors
By participating in Intertidal® activities, clients confirm that they understand and accept these inherent risks.
Intertidal® shall not be held liable for accidents, injuries, loss, or damage resulting from:
* failure by participants to follow safety instructions provided by guides or instructors
* inappropriate behaviour or negligence by participants
* participation despite medical or physical conditions that may affect safety
* activities undertaken outside the scope of the official program
* personal belongings lost or damaged during the activity
Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is not permitted under Portuguese or European Union law, including liability for gross negligence or intentional misconduct.
Participants remain responsible for their personal conduct and must act with reasonable care to ensure their own safety and that of other participants.
21. Fitness to Participate
By booking and participating in any Intertidal® activity, clients confirm that they are in adequate physical and mental condition to safely take part in the activity.
Participants acknowledge that certain activities may require:
* moderate physical effort
* the ability to swim (for water-based activities)
* balance and coordination
* the ability to follow safety instructions from guides or instructors
Participants must inform Intertidal® in advance if they suffer from any medical condition that may affect their ability to participate safely, including but not limited to:
* heart conditions
* respiratory illnesses
* mobility limitations
* recent injuries or surgeries
* pregnancy
* any other relevant medical condition
Intertidal® reserves the right to refuse participation in an activity where there are reasonable concerns regarding a participant’s safety or the safety of others.
Where appropriate, participants may be asked to provide a **medical declaration or certificate confirming their fitness to participate**.
Participants are responsible for ensuring that they have the necessary physical ability and health condition to safely participate in the selected activity.

Tourism entertainment operators must clearly indicate the regulatory authority overseeing their activity.

3. Consumer Dispute Resolution (Required in the EU)
EU consumer law requires companies to provide information about **Alternative Dispute Resolution (ADR)** bodies.
Since Intertidal is based near Caldas da Rainha, the most appropriate entity is:
