Intertidal Natureza & Aventura: Aluguer de Bicicletas Intertidal®

1 – Objeto

Este regulamento tem como objetivo definir as condições e responsabilidades civis do cliente/locatário que celebra com a Intertidal®, Francisco Miguel S. Azevedo e Castro, NIF: 199605386, com sede na Rua F.A. Grandella, nº 115, 2500-487 Foz do Arelho, um contrato temporário com prazo fixo para aluguer e utilização de bicicletas.

2 – Disposições Gerais

As bicicletas alugadas aos clientes são propriedade exclusiva da Intertidal® e destinam-se a passeios de lazer nos concelhos de Caldas da Rainha e/ou Óbidos.

3 – Termos e Condições

Termos:

a) O cliente/locatário compromete-se a assumir a responsabilidade por quaisquer danos ou perdas da(s) bicicleta(s) e acessórios durante o período de aluguer.

b) O cliente/locatário tem a responsabilidade e obrigação de respeitar o código da estrada.

c) Nos alugueres com pernoita, é da responsabilidade do cliente/locatário guardar a bicicleta em local seguro e dentro de portas.

Condições:

a) A Intertidal® não exige o pagamento de qualquer caução ou depósito em dinheiro.

b) É obrigatória a entrega de um documento de identificação.

c) Todas as bicicletas são alugadas com cadeado. – Mostraremos como utilizar corretamente os cadeados durante o processo de aluguer.

d) Serão fornecidos capacetes pela Intertidal®, sempre que solicitados, sem custo adicional. – O uso de capacete é recomendado para utilizadores de bicicletas elétricas e obrigatório para todos os menores de 12 anos.

4 – Preços de Aluguer

Os preços de aluguer são os constantes na tabela de preços afixada em local visível na loja da Intertidal® ou dos seus parceiros.

Aos preços apresentados acresce IVA a 23%.

O preço de aluguer inclui cadeado e capacete (opcional).

5 – Seguro e Acidentes

O aluguer não implica qualquer seguro de responsabilidade civil ou seguro de acidentes pessoais por parte da Intertidal®.

O cliente é sempre responsável pelos danos na bicicleta, a terceiros e a si próprio.

6 – Avarias

Em caso de qualquer avaria no equipamento alugado por culpa do cliente, este deverá notificar imediatamente a Intertidal® e entregar a bicicleta na loja, sendo cobrado pela Intertidal® o valor correspondente ao tempo estimado de imobilização do equipamento.

Em caso de avaria no equipamento alugado sem culpa do cliente, este deverá notificar de imediato a Intertidal® e entregar a bicicleta na loja, sendo esta substituída por outra similar.

7 – Assistência em Viagem

A Intertidal® pode prestar assistência em viagem em caso de qualquer tipo de avaria no equipamento alugado, seja ou não por culpa do cliente. Este serviço deve ser solicitado pelo cliente e tem um custo mínimo associado de €10,00.

8 – Roubo, Perda e Danos

O valor do aluguer não inclui seguro contra roubo, perda total ou parcial da bicicleta (ou outros danos), nem danos (em equipamentos, mecânica ou objetos pessoais transportados no veículo), por qualquer circunstância, seja por vandalismo ou acidente de viação.

Para outros riscos (roubo, perda, danos no veículo), existe um valor de responsabilidade a ser pago pelo cliente no montante de:

Bicicleta citadina – 562€ (IVA incl.)

Bicicleta trekking – 679€ (IVA incl.)

Bicicleta elétrica – 2750€ (IVA incl.)

A perda ou dano de acessórios (chaves, capacete, etc.) não está coberta por este valor de responsabilidade e será cobrada de acordo com a tabela de preços geral.

9 – Peças Danificadas

No caso de danos parciais ou perda de acessórios, o cliente estará sujeito ao pagamento à Intertidal® do valor correspondente à reparação ou substituição das peças danificadas, conforme tabela de preços em vigor na data da assinatura do contrato.

10 – Omissões

Para os casos omissos neste regulamento, as partes envolvidas são regidas pela legislação aplicável.

Terms and conditions

Intertidal Natureza & Aventura: Bike rentals Intertidal®

1 – Object

This regulation is in order to define the conditions and civil responsibilities of client/renter who celebrate with Intertidal®, Francisco Miguel S Azevedo e Castro TaxP: 199605386, with headquarters in Rua F.A.Grandella, nº 115, 2500-487 Foz do Arelho, temporary contract with fixed term rental and the use of bicycles.

2 – General Provisions

The bikes to rent to customers are the exclusive property of Intertidal®. and are intended for leisure trips in the municipalities of Caldas da Rainha and/or Óbidos

3 – Terms and conditions

Terms:

a) Customer/renter agrees to take responsibility for any damage or loss of bicycle(s) and accessories during the rental period.

b) The customer/renter has the responsibility and the obligation to respect the traffic rules.

c) In overnight rentals it is the responsibility of the customer /renter to park the bicycle in a safe place within doors.

Conditions:

a) Intertidal® does not require the pre-payment of any bail or cash deposit.

b) It is mandatory to leave an identification document.

c) All bikes are rented with padlock. – We will show you how to use the locks properly during the hiring process.

d) Will be provided by Intertidal®, helmets whenever requested at no extra cost. – The use of a helmet is recommended for users of electric bicycles and mandatory for all minors up to 12 years old.

4 – Rental prices

The rental prices are the ones that are included in the price list posted in a place visible in Intertidal’s store or partners.

The prices are not exempt of VAT. The rental price includes locks and helmets (optional).

5 – Insurance and accidents

The rental does not imply any liability insurance or personal accident insurance by Intertidal®.

The customer is always Responsible for the damages on the bike, to others and to himself.

6 – Malfunctions

In case of any malfunction in the rental equipment by client’s fault, he should notify immediately Intertidal® and deliver the bike in the shop, being charged by Intertidal®, the amount corresponding to the estimated time of stoppage of the equipment.

In case of any malfunction in the rental equipment without the customer’s fault, he should notify immediately the Intertidal® and deliver the bike in the shop, which is replaced by another similar.

7 – Travel assistance

Intertidal®. can provide travel assistance in the event of any type of breakdown in the rented equipment, through the fault or no fault of the customer. This service has to be requested by the customer and has a minimum associated cost of €10.00.

8 – Theft, loss and damages

The rental amount does not include insurance against theft, total or partial loss of the bicycle (or other damages), or damage (as in your equipment, mechanics or personal effects carried on the vehicle), for any circumstance, whether by vandalism or traffic accident.

For other risks (theft, loss, damage to the vehicle) there is a liability amount to be paid by the customer in the amount of:

City bike – 562€ (VAT incl.)

Trekking bike – 679€ (VAT incl.)

e-bike – 2750€ (VAT incl.).

Loss or damage of accessories (keys, helmet, etc.) are not covered by the liability amount and will be charged according to the general price list.

9 – Damaged parts

In the case of partial damages or loss of accessories, the customer will be subject to the payment to Intertidal® of the amount corresponding to the repair and replacement of the damaged parts in accordance with the price list at the time of signat

ure of the contract.

10 – Omissions

For cases omitted in this regulation, stakeholders are ruled by applicable law.
